The UK Supplier Market Splits Four Ways, and the Split Matters

British buyers of custom software rarely fail because they picked a bad firm. They fail because they compared firms that were never selling the same thing. Four distinct kinds of supplier answer the same search term. Consultancies and systems integrators sell governed programmes with account structures, methodology, and a pyramid of grades behind the lead partner. Bespoke software houses sell delivery: a standing engineering team, a product owner, and a roadmap. Design led digital studios sell the experience layer and build the software that carries it, which suits customer facing products and suits a claims engine much less. Finally, a large part of the market is contractor supply with a company name on the front, assembling independent specialists per engagement.

None of those is a bad answer. Sending one request to all four and reading the totals is a bad method. Work out first whether your project needs governance, continuity, design judgement, or raw capacity, then shortlist inside that group and compare like with like.

Off-Payroll Rules Changed Who Is Really on Your Project

The status rules around off-payroll working, commonly discussed as IR35, reshaped how software engineering talent is contracted across the country, and they reach buyers as well as suppliers. Many firms responded by moving from day rate contracts to statement of work agreements, which is a legitimate change if the supplier genuinely takes responsibility for an outcome, and a cosmetic one if the same person still sits in your stand up taking direction from your manager.

The practical consequence is that you need to know the employment status of everyone named in a proposal. Ask which individuals are employees of the signing company, which are limited company contractors, and which arrive through an intermediary. Ask who determines status and who carries the liability if that determination is challenged. Then make the agreement match reality: if you are buying an outcome, define the outcome, let the supplier manage its own people, and stop treating the team as an extension of your line management. Buyers who want the flexibility of contractors without the exposure should price that honestly rather than dress it as a managed service.

Read the Filings Before You Read the Pitch

The company register makes diligence unusually easy here and most buyers still skip it. Pull the filing history for every shortlisted supplier. Look at how long the entity has existed, whether accounts are filed on time, whether the directors have a trail of dissolved companies behind them, and whether the trading name on the proposal belongs to the entity that will sign. Groups often pitch under a brand and contract through a small subsidiary with very little behind it, which matters the day you need to enforce something.

Ask for evidence of professional indemnity cover and check that the sum insured is sensible against the value of what you are commissioning. If the supplier is small and the software is critical, ask whether a parent company guarantee is available. None of this predicts good engineering, but it tells you what happens if the engineering goes wrong, and that is the part buyers usually discover too late.

Public Bodies Buy Software Through a Different Door

If you are commissioning on behalf of a public organisation, the route is set before the requirement is. Purchasing runs through established buying frameworks and marketplaces, with defined lotting, published evaluation criteria, and standstill obligations, and spend above certain control points needs approval before the market is approached. Service assessments against the published digital service standard apply to public facing services, and accessibility regulations make conformance with WCAG 2.1 at the AA level a duty rather than a preference, together with a published accessibility statement.

There is also a policy preference for open source, open standards, and avoiding lock in, which is worth taking seriously even in the private sector. Ask candidates how they would hand the codebase to a successor supplier, what proprietary components they would introduce, and what the exit would cost. Suppliers used to public work answer that fluently; suppliers who have never faced it tend to bristle, which is itself informative.

Data Protection Is an Input to Design, Not a Clause at the End

Domestic data protection law sits alongside the regulator's guidance, and the obligations land on you as controller even when a supplier holds the data. A data protection impact assessment belongs in the discovery phase for anything involving personal data at scale, special category data, or automated decisions about people. The processor agreement needs to name sub-processors, restrict onward transfer, and set breach notification timing that lets you meet your own reporting duty.

Ask where production and backup data will physically sit, which support staff can read it, how access is granted and revoked, and what happens to the data at the end of the contract. If any part of the team works from outside the country, ask which transfer mechanism the supplier relies on and get it in writing. Recognised certification such as ISO 27001 helps, but read the scope statement on the certificate rather than the logo in the deck, because scopes are often narrower than buyers assume.

Pricing Models and What Each One Conceals

Three commercial shapes dominate. Fixed price transfers uncertainty to the supplier, who prices it, which is efficient when the requirement is genuinely stable and expensive when it is not. Day rate engagements are the traditional British default and are easy to start and hard to stop; blended rates in particular hide the mix of seniority you are actually buying, so ask for the rate card by grade and the planned allocation by week. Capped time and materials with a defined change process sits between the two and suits most bespoke software work.

Whichever you choose, tie payments to accepted deliverables rather than elapsed time, agree defect severity classes with fix times, and keep a warranty period after go live. Discovery is frequently sold as a separate small engagement; that is reasonable, but agree up front that the artefacts belong to you and can be taken to another supplier without penalty.

Sending a Comparable Brief Across the UK

Give every candidate the same document: the business problem, the systems to integrate, the data protection position, the commercial model you intend to use, acceptance criteria, and the support expectation after launch. Ask each to name the team, state what it would do in the first month, and provide two references on work of similar size that you will actually call.

If the deliverable is mainly a public facing product, put web engineering firms and application developers into the same comparison, since that shape of work usually prices lower. Buyers who want a city level list can look at suppliers in the capital, the north west, the Scottish market, or the south west. Verified profiles and references for software companies are held on Edvido, and you can issue a single brief to your shortlist so the responses arrive in a shape that can be scored rather than merely read.
